Current DACA Status as of July 2021:
  • On July 16, 2021, a federal district court judge in Texas ruled that enactment of DACA violated the Administrative Procedures Act. The effect of this ruling is as follows:
    • Any new DACA application not approved by July 16, 2021 can be processed, but may not be approved
    • Current DACA recipients will maintain their current DACA status
    • The government will continue to process and may approve DACA renewal applications, regardless of when they were or are submitted

  • The Biden Administration has said it will appeal the ruling. The impacts outlined here may change depending on the outcome of any appeal.

General steps to renew DACA:
  • Keep track of of your DACA expiration date.
  • Be aware of your renewal window.
    • Submit your DACA renewal no later than 120 days before your expiration date 
  • Find your previous DACA renewal application
    • This is to ensure that your information stays consistent among all your DACA renewal applications
  • Download the right application forms from USCIS
    • USCIS will reject applications if it not the right one.
  • Accurately fill out the application
    • You can use your previous renewal application to ensure that the information is consistent.
  • Get legal advise if necessary. If you are a current OSU student you can consult with ASOSU Legal services 
  • Create a cover letter
    • This can be useful for your application process as it provides the agent reviewing your application a glance of application package.
  • Prepare your DACA renewal fees
    • You will have to pay the $495 fee to renew your DACA. It is encouraged to do the payment in the form of a money order or cashiers' check. However you can still used a personal check. The money order should be made out to the “U.S. Department of Homeland Security.” (not “USDHS” or “DHS”). This will cover your biometric and processing fees.
  • Prepare and send your application
    • Have your documents together with a paper clip, do not staple
    • Organize them in the following order:
      • $495 fee
      • Cover Letter
      • Complete Form G-1145
      • Complete Form I-821D
      • Complete Form I-765
      • Complete Form I-765WS
      • Copies of any supporting evidence
